Penalties for Driving Under the Influence

First time DUI offenders can expect to face at least a one year license suspension and fines. If a child under the age of 18 was in the car, you could face up to five days in jail. With each consecutive offense thereafter, you can expect an increase in the penalties you may be facing. For example, second time offenders will have their licenses revoked for up to three years and spend a minimum of ten days in jail.

For third time offenders, you could spend a minimum of 90 days in jail and face license suspension, steep fines, and probation. Virginia is also an implied consent state, which means that if you refuse to take the breath test, you could face extended consequences similar to the penalties for a DUI conviction.
